Code of Practice for Subdivision, Land Use, and Development

Invercargill City Council and Southland District Council welcome feedback and submissions from interested members of the community regarding the proposed adoption of a new Code of Practice for Subdivision, Land Use, and Development.

It is proposed that the current applicable Bylaws be revoked and replaced with an updated Code of Practice. Invercargill City Council has worked in partnership with Southland District Council to create a single joint Code of Practice, in order to provide consistency throughout Invercargill and the wider Southland district.

The Code of Practice will set minimum standards and guidance for assets that both Councils will accept as part of their networks, including for the ongoing operations and maintenance of these assets, and for network assets which will remain in private ownership but connect to public assets.

We are consulting on the following steps:

• Revoking the current ICC Code of Practice for Land Development and Subdivision Infrastructure Bylaw and the SDC Subdivision, Land Use and Development Bylaw.
• Adopting a new Code of Practice to apply across the whole of Invercargill and Southland.
• Changes to the District Plans to reflect the changes to the Code of Practice.

The main proposed updates to the Code of Practice include:

• Alignment of minimum standards and guidance across both SDC and ICC.
• The design and construction of roads, Three Waters networks, and updated standard engineering details, to align with latest good practice and regional preferences.
• The design and construction of landscapes and community facilities.

Southland District Council Bylaw Revocation and District Plan

Upon adoption of the Code of Practice, the Southland District Council's Subdivision, Land Use and Development Bylaw 2012 will be revoked. The Local Government Act states that when revoking a Bylaw, Councils are required to use the Special Consultative Procedure which includes the preparation of a Statement of Proposal. This can be found in the Documents section.

Submissions

If you would like to make a submission on the proposed Code of Practice, the easiest way to do so is using the link below. Submissions are due by 8 June 2023. Alternatively, you can pick up a submission form and drop one off to Te Hīnaki Civic Building in Esk Street, the Public Library or the Bluff Service Centre, or any Southland District Council office, or post it to Invercargill City Council. You can also email submissions to the ICC Strategy and Policy Team at policy@icc.govt.nz.
